PROTECTION OF PERSONAL DATA

The seller undertakes to protect all personal data of the user in perpetuity.

The seller stores indefinitely the IP addresses of all visitors to the online shop www.lumyway.com and, in the case of customers, the following: name and surname, e-mail address, contact telephone number, main and delivery addresses, country of residence, gender, time and date of purchase and an archive of communications with the Seller.

The seller will use the personal data solely for the purpose of fulfilling the order (sending information material, offers, invoices) and other necessary communication.

Under no circumstances will we disclose user data to unauthorised persons.

The user is also responsible for protecting his/her personal data by ensuring the security of his/her username and password and by ensuring that his/her computer is protected by appropriate software (antivirus).

You must be over 18 years old to purchase or use products from the lumyway.com online store. By confirming your agreement to the Terms and Conditions below, you also confirm that you are over 18 years of age.

These terms and conditions are published on the lumyway.com website in the ''Terms and Conditions'' section in the footer of the "Check out" page. By posting them on the website, the buyer is deemed to be aware of the terms and conditions and by entering into the purchase agreement, the buyer declares that he/she has read and is fully familiar with the terms and conditions.

If the Buyer declares that he does not agree with the amended Terms and Conditions, the Company has the right to withdraw from the contract.

 

REGISTRATION

By registering on www.lumyway.com you become a member of the online store. Both registered members and guests who make a quick purchase and do not need to register before making a purchase have the right to shop in the online store.

When registering in the Online Shop, a visitor receives a username, which is identical to his/her e-mail address, and a password. If a user wants to change his e-mail address or password at any time, he can do so in his user profile.

 

PRODUCT OFFER

Product prices are shown as retail prices and do not include value added tax (VAT) according to § 94 Abs. 1 ZDDV-1: we are not a company subject to VAT. Product prices do not include shipping costs. Occasionally prices fluctuate depending on current promotions.

Due to the nature of online business, the range of products in the online store changes and is updated and therefore errors may occur. In order to eliminate the errors as soon as possible, the company asks that the customer report them through the contact information published on the website.

We try to display the color images of our products as accurately as possible, but we cannot guarantee that the color display on your monitor will match the real product.

The online store is powered by Shopify Inc. which provides an online platform for selling our products.

 

METHODS OF PAYMENT

 The online store allows the following payment methods:

- By proforma invoice (UPN Universal Payment Order) to the company's account.

- By payment or credit card (Mastercard, Visa, American Express)

- Through the PayPal system

The Company ensures that when concluding a distance contract electronically, the Customer expressly confirms in the course of the order that he/she agrees to the payment through the order. The function that triggers the order is marked with the words "confirm order". By confirming the order, the consumer assumes the obligation to pay the company.

 

PRICES

The prices do not include value added tax (VAT), because we are not a company subject to VAT due to § 94 Abs. 1 ZDDV-1.

Prices are valid at the time of ordering and have no predefined validity.

Prices in the online store www.lumyway.de are the same for both registered members and guests of the online store.

The purchase contract between the seller and the buyer is concluded at the moment when the seller confirms the order (the buyer receives an electronic message about the status "order confirmed"). From this moment all prices and other conditions are fixed and apply to both the company and the buyer.

 

DISCOUNT CODE

The discount code brings various benefits (product discounts, free shipping...) to the purchase and is limited in time. An active promo code is published by the Seller in a manner consistent with the purpose of the Seller's marketing campaign. The Seller does not guarantee that there will be an active promo code at the time of purchase.

You can find an active code on the first page of the advertisement, in an email or in other media. The code comes with various benefits. Each code is always time-limited, but it must be redeemed within a certain time, otherwise it will be invalid.

 

PURCHASE NOTIFICATION PROCEDURE

After placing the order, the customer will receive an email notification that the order has been accepted and will receive the tracking number of their package in the next email.

The online store may call the customer at his contact phone number to verify the data or ensure the accuracy of the delivery.

 

CONSUMER'S RIGHT TO WITHDRAW FROM THE CONTRACT - REIMBURSEMENT

In the case of distance contracts, the consumer has the right to clearly and unambiguously notify the company by e-mail to ask@lumyway.com within 14 days of receipt of the goods that he/she is withdrawing from the contract, without having to give a reason.

The buyer may inspect and examine the received goods only to the extent that this is absolutely necessary and customary in the trade to determine the actual condition. Any "inspection" that deviates from this may be considered use of the goods, and the buyer is responsible for the reduction of the value of the goods in accordance with the eighth paragraph of Article 43d ZVPot, if the reduction is due to conduct that is not strictly necessary to determine the nature, characteristics and operation of the goods.

The consumer must immediately, or at the latest within 14 days of notification that he withdraws from the order, return the goods to the company at the address: LUMYWAY, Jagoda Tadic s.p., Titova 74, 4270 Jesenice, Slovenia. The consumer has returned the goods in time if he/she sends them before the expiry of the 14-day return period (the postmark will be checked).

 

The consumer bears the cost of returning the goods, in case of withdrawal from the contract, if necessary. The only costs that the buyer has in connection with the withdrawal from the order are the direct costs of returning the goods. When returning the goods, the consumer also sends the invoice for the goods and personal data and a bank account to which he wants to receive the refund. The refund shall be carried out by the Company without undue delay, but no later than within 14 days from the date of receipt of the notification of withdrawal from the contract.

The Company may refuse to refund services received until the goods have been returned or until the Consumer has provided proof that he/she has returned the goods. Shipping costs for returned goods are not refundable and the costs are not included in the refund.

The Buyer must return the goods to the Seller (LUMYWAY s.p.) undamaged and in unchanged quantity, unless the goods are destroyed, damaged, lost or their quantity has decreased through no fault of the Consumer.

In case of return of the goods due to the use without the original packaging or the damage of the goods, the company can claim the buyer for the refund of the value of the goods.

In case of withdrawal from the contract, if a discount code was used, these funds will be considered as a discount and will not be returned to the user. Only the amount paid will be returned to the user's bank account.

 

SHIPPING COSTS

The seller ships the products worldwide. In the section "Delivery costs" you can find information about delivery times and shipping costs. All orders from outside the EU may be subject to customs duties and taxes, which must be paid upon arrival of the shipment and are not included in the shipping costs. Customs costs vary from country to country. If the buyer needs detailed information about customs costs, the seller will refer him to the local customs office.

LUMYWAY uses appropriate technological and organizational means to protect the transmission and storage of personal information, orders and payments. Credit card authorizations are performed in real time with immediate verification of data with banks. The card data are not stored on the server.

The User is also responsible for the protection of personal data by ensuring the security of his/her user name and password, as well as appropriate software protection (antivirus) of his/her computer.

 

DISCLAIMER

We reserve the right to shut down or block access to the website due to technical or other problems and maintenance, which also means blocking or hindering the use of the online store. In case of technical problems on the website, we reserve the right to cancel orders placed that are affected by a technical error. In case of order cancellation, we will notify you as soon as possible and inform you about the next steps. You must ensure that the devices (antivirus, etc.) are sufficiently protected against access and use of the website. The customer must ensure the appropriate security and confidentiality of the data used to log in to the website (email address, password).
